Ayn\u0131 zamanda maddi hukuk taraf\u0131ndan hak sahibine sa\u011flanan hukuki koruman\u0131n yerine getirilmesini sa\u011flar. Bu hukuk dal\u0131n\u0131n g\u00f6revini yerine getirebilmesi i\u00e7in 2004 say\u0131l\u0131 \u0130cra ve \u0130flas Kanunu \u00e7er\u00e7evesinde icra ve iflas daireleri kurulmu\u015ftur.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span id=\"Tahliye_Taahhutnamesi_Nedir\">Tahliye Taahh\u00fctnamesi Nedir?<\/span><\/h3>\n\n\n\n<p><\/p>\n\n\n\n<p class=\"has-medium-font-size\">Tahliye taahh\u00fctnamesi kirac\u0131 s\u0131fat\u0131 bulunan ki\u015finin tek tarafl\u0131 olarak m\u00fclk sahibi kiralayana yapt\u0131\u011f\u0131 bir irade beyan\u0131d\u0131r. Bu irade beyan\u0131, kirac\u0131n\u0131n m\u00fclk\u00fc belirli bir s\u00fcrede terk edece\u011fine dair d\u00fczenlenir. Di\u011fer irade beyanlar\u0131n\u0131n aksine mevzuat h\u00fck\u00fcmlerince d\u00fczenlenmi\u015f \u015fartlar\u0131 bulunan bir irade beyan\u0131d\u0131r.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span id=\"Tahliye_Taahhutnamesi_Ile_Icra_Takibi\">Tahliye Taahh\u00fctnamesi \u0130le \u0130cra Takibi<\/span><\/h3>\n\n\n\n<p><\/p>\n\n\n\n<p class=\"has-medium-font-size\">Tahliye taahh\u00fctnamesi ile icra takibi ba\u015flatabilmek i\u00e7in ge\u00e7erli bir tahliye taahh\u00fctnamesi ve kira s\u00f6zle\u015fmesi ile icra dairesine gerekli form ile ba\u015fvuru yap\u0131lmal\u0131d\u0131r. Ba\u015fvuru yap\u0131lmadan \u00f6nce kirac\u0131ya ihtar \u00e7ekilmesi gerekmemektedir. Burada dikkat edilecek en \u00f6nemli hususlardan bir tanesi tahliye taahh\u00fctnamelerinin 1 ayl\u0131k hak d\u00fc\u015f\u00fcr\u00fcc\u00fc s\u00fcreye tabi olmas\u0131d\u0131r. Tahliye taahh\u00fctnamesinde verilen tahliye tarihinin \u00fczerinden 1 ay ge\u00e7tikten sonra bu taahh\u00fctnameye dayanarak i\u015flem yap\u0131lamamaktad\u0131r.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Ba\u015fvuru yap\u0131ld\u0131ktan sonra kirac\u0131ya icra dairesi taraf\u0131ndan bir tebligat g\u00f6nderilecektir. Kirac\u0131n\u0131n bu tebligata 7 g\u00fcn i\u00e7erisinde itiraz etmesi m\u00fcmk\u00fcnd\u00fcr. Burada yap\u0131labilecek kirac\u0131 tahliye taahh\u00fctnamesinde bulunan tarihe veya imzas\u0131na itiraz edebilir. Bu itiraz sonucu icra takibi durmaktad\u0131r. Bu yap\u0131lan itiraza kar\u015f\u0131 kiraya veren sulh hukuk mahkemesinde itiraz\u0131n iptali davas\u0131 a\u00e7arak icra takibinin devam etmesini sa\u011flayabilir. Kirac\u0131ya g\u00f6nderilen tebligata kar\u015f\u0131l\u0131k 7 g\u00fcnl\u00fck s\u00fcre i\u00e7erisinde bir itiraz yap\u0131lmaz ise icra takibi kesinle\u015ftirilir. Kesinle\u015fen icra takibi sonras\u0131nda kirac\u0131n\u0131n m\u00fclk\u00fc bo\u015faltmas\u0131 i\u00e7in 30 g\u00fcnl\u00fck s\u00fcre verilir. Bu s\u00fcre i\u00e7erisinde kirac\u0131 evi tahliye etmez ise icra dairesi arac\u0131l\u0131\u011f\u0131 ile ev tahliye ettirilerek ev kiralayana teslim edilir.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Kirada bulunan m\u00fclk\u00fcn i\u00e7erisinden kirac\u0131n\u0131n e\u015fyalar\u0131 ta\u015f\u0131n\u0131p m\u00fclk bo\u015falt\u0131lana kadar m\u00fclk sahibine teslim edilmez. E\u011fer kirac\u0131 verilen 30 g\u00fcnl\u00fck s\u00fcre i\u00e7erisinde ta\u015f\u0131nmaz ise bu ta\u015f\u0131may\u0131 yapmaya sadece icra dairesi yetkilidir.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span id=\"Tahliye_Taahhutnamesinin_Gecerlilik_Sartlari\">Tahliye Taahh\u00fctnamesinin Ge\u00e7erlilik \u015eartlar\u0131<\/span><\/h3>\n\n\n\n<p><\/p>\n\n\n\n<p class=\"has-medium-font-size\">Tahliye taahh\u00fctnamesinin ge\u00e7erli olabilmesi i\u00e7in T\u00fcrk Bor\u00e7lar Kanunu 352. maddesi gere\u011fince a\u015fa\u011f\u0131da bulunan \u015fartlar\u0131 sa\u011flamas\u0131 gerekmektedir;<\/p>\n\n\n\n<ul>\n<li class=\"has-medium-font-size\">Tahliye taahh\u00fctnamesi yaz\u0131l\u0131 olarak yap\u0131lmal\u0131d\u0131r. Bu taraflar aras\u0131nda d\u00fczenlenebilece\u011fi gibi noter onayl\u0131 da yap\u0131labilmektedir. Yaz\u0131l\u0131 olarak yap\u0131lmayan tahliye taahh\u00fctnamesi ge\u00e7ersiz say\u0131lacakt\u0131r.<\/li>\n\n\n\n<li class=\"has-medium-font-size\">Tahliye taahh\u00fctnamesi kira s\u00f6zle\u015fmesinden ve kiralanan\u0131n tesliminden sonra yap\u0131lmal\u0131d\u0131r. Ayn\u0131 tarihte verilen taahh\u00fctnameler ge\u00e7ersiz say\u0131lacakt\u0131r.<\/li>\n\n\n\n<li class=\"has-medium-font-size\">Tahliye taahh\u00fctnamesinde kirac\u0131n\u0131n imzas\u0131 yer almal\u0131d\u0131r. E\u011fer kira s\u00f6zle\u015fmesinde birden fazla kirac\u0131n\u0131n imzas\u0131 mevcut ise b\u00fct\u00fcn kirac\u0131lar\u0131n tahliye taahh\u00fctnamesini imzalam\u0131\u015f olmas\u0131 gerekmektedir.<\/li>\n\n\n\n<li class=\"has-medium-font-size\">Tahliye taahh\u00fctnamesinde tahliye tarihi bulunmal\u0131d\u0131r.<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span id=\"Tahliye_Taahhutnamesinin_Gecersiz_Sayilacagi_Durumlar\">Tahliye Taahh\u00fctnamesinin Ge\u00e7ersiz Say\u0131laca\u011f\u0131 Durumlar<\/span><\/h3>\n\n\n\n<p><\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u00d6ncelikli olarak yaz\u0131l\u0131 olarak yap\u0131lmayan tahliye taahh\u00fctnamesi ge\u00e7ersiz say\u0131lacakt\u0131r. Bu kanunda say\u0131lan \u015fartlardan bir tanesidir. Burada taahh\u00fctnamenin kirac\u0131n\u0131n vermesi de \u00f6nem arz etmektedir. Kirac\u0131 d\u0131\u015f\u0131nda evde ya\u015fayan di\u011fer ki\u015filer tahliye taahh\u00fctnamesi veremez. Kira s\u00f6zle\u015fmesinde imzas\u0131\/imzalar\u0131 olan ki\u015fi\/ki\u015filerin tamam\u0131n\u0131n tahliye taahh\u00fctnamesinde de imzas\u0131 olmas\u0131 \u015fartt\u0131r.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Tahliye taahh\u00fctnamesinde belirli bir tahliye tarihinin verilmesi zorunludur. Yarg\u0131tay kararlar\u0131na g\u00f6re sadece ay ve y\u0131l belirtilen tahliye taahh\u00fctnameleri ge\u00e7erli olup belirtilen ay\u0131n son g\u00fcn\u00fc i\u00e7in taahh\u00fctnamenin verildi\u011fi anla\u015f\u0131lmal\u0131d\u0131r. Ayr\u0131ca taahh\u00fctnamenin verildi\u011fi tarih kira s\u00f6zle\u015fmesinin yap\u0131ld\u0131\u011f\u0131 tarihte veya \u00f6ncesinde olamaz. Kira s\u00f6zle\u015fmesi yap\u0131lmadan \u00f6nce ev sahiplerinin kirac\u0131lar \u00fczerindeki bask\u0131s\u0131 dikkate al\u0131nd\u0131\u011f\u0131nda bu tarihlerde verilen tahliye taahh\u00fctnameleri \u00f6zg\u00fcr irade ile verilmemi\u015f ve ge\u00e7ersiz say\u0131lmaktad\u0131r.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Bunun yan\u0131nda tahliye taahh\u00fctnameleri bir \u015farta dayanarak verilemez. E\u011fer tahliye taahh\u00fctnamesi bir olay\u0131n ger\u00e7ekle\u015fmesi \u015fart\u0131na ba\u011flanm\u0131\u015fsa ge\u00e7ersiz say\u0131lacakt\u0131r. Tahliye taahh\u00fctnamesi kay\u0131ts\u0131z ve \u015farts\u0131z olarak verilmelidir.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Son olarak tahliye taahh\u00fctnamesinin imzalanmas\u0131 s\u0131ras\u0131nda genel hukuk kurallar\u0131na ayk\u0131r\u0131l\u0131klar mevcut ise (hata, hile, korkutma gibi) bu taahh\u00fctnameler irade sakatl\u0131\u011f\u0131 sebebi ile ge\u00e7ersiz say\u0131lmaktad\u0131r.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span id=\"Noterde_Yapilan_Tahliye_Taahhutnamesi\">Noterde Yap\u0131lan Tahliye Taahh\u00fctnamesi<\/span><\/h3>\n\n\n\n<p><\/p>\n\n\n\n<p class=\"has-medium-font-size\">Noterde yap\u0131lan tahliye taahh\u00fctnamesi ile ba\u015flat\u0131lan icra takiplerine itiraz edilemez. Burada yap\u0131lan taahh\u00fctnameler noter huzurunda d\u00fczenlendi\u011fi i\u00e7in yap\u0131lan itirazlar ge\u00e7ersiz say\u0131lmaktad\u0131r.
